Chairwoman of the Public Works, Capital Projects and Transportation Committee, Laura Petit, and Deputy Chair Dean J. Fabiano offer the following:
WHEREAS this resolution has been submitted at the request of the Acting County Executive on behalf of the Department of Public Works and the Ulster County District Attorney; and
WHEREAS the Ulster County District Attorney is an independently elected public official whose powers and duties are set forth in section 700 of the County Law and responsible for prosecuting all crimes and offenses which occur within Ulster County; and
WHEREAS the Ulster County District Attorney’s Office provides equal justice while focusing on those crimes; and
WHEREAS the Ulster County District Attorney’s Office covers criminal prosecutions in each town and village justice court, Kingston City Court, and Ulster County Court, and requires communication with victims, witnesses, law enforcement, defense counsel advocates for both the victim and defendant, forensic experts, and medical experts; and
WHEREAS, in addition to the general office activities, district attorneys need adequate space to interview witnesses and police officers, conduct legal research, maintain case files, conduct investigations, prepare written reports and documents, and prepare for court appearances which require reception and waiting areas, interview rooms, record storage areas, clerical offices, private offices, conference rooms, library, mail sorting and clerical workrooms, supply and equipment storage areas; and
WHEREAS the County of Ulster has identified an opportunity at 273 Wall Street, City of Kingston, Ulster County, New York. Tax Parcel ID#; 48.331-7-6 to lease and utilize office space totaling 2,500 square feet for $25.00 per square foot; and
WHEREAS the leased office space is centrally located immediately adjacent to the Ulster County Court house and provides five designated off-street parking spots for employees; and
WHEREAS, the Commissioner of Public Works has requested to execute a lease agreement with Tappen House Development LLC,, for a five (5) year term commencing December 1, 2022 through November 30, 2027, at an annual cost of $62,500.00 for the first year of the lease; and
WHEREAS, the lease shall contain a clause which will allow the tenant, County of Ulster, the option to terminate the lease for any reason or for no reason, upon ninety (90) days written notice to the landlord Tappen House Development LLC.; now, therefore, be it
RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to enter into a lease agreement with Tappen House Development LLC, for office space for the Ulster County District Attorney’s Office located at Wall Street, City of Kingston, Ulster County, New York. Tax Parcel ID#; 48.331-7-6, in the form as filed with the Clerk of the Ulster County Legislature or as modified and approved by the County Attorney,
and move its adoption.
