Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and Deputy Chair Manna Jo Greene offer the following:
WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Public Works; and
WHEREAS, pursuant to Resolution No. 314 dated September 11, 2007, the County entered into a lease with the Spring Lake Fire Department for space at the premises located at 125 Maxwell Lane, Kingston, for use as the Central Auto Garage, beginning September 15, 2008 and ending September 14, 2013; and
WHEREAS, pursuant to Resolution No. 263 dated October 22, 2013, the County exercised the first of its two options under the lease to extend the lease term for an additional five (5) years, for a term beginning September 15, 2013 and ending September 14, 2018; and
WHEREAS, pursuant to Resolution No. 462 dated November 20,2018, the County exercised the second of its two options under the lease to extend the lease term for an additional five (5) years, for a term beginning September 15, 2018 and ending September 14, 2023; and
WHEREAS, pursuant to Resolution No. 543 dated December 18, 2019, the County exercised a rider to the lease for 28,125 square feet of space to be used as an impound lot ending September 14, 2023; and
WHEREAS, the County has now canceled this lease and rider and moved Central Auto to the Department of Public Works Quarry; and
WHEREAS, the County still requires the previously leased rider space in order to build the originally planned impound lot; and
WHEREAS, the Commissioner of Public Works has requested the Chair of the Ulster County Legislature be authorized to enter into a Lease Agreement with Spring Lake Fire Department for 28,125 square feet of space, for a 5-year term, beginning November 15, 2020 and ending November 14, 2025, at an annual cost of $16,000.00; now, therefore be it
RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute a lease agreement and any amendments thereto, with Spring Lake Fire Department for a county Impound Lot located at 125 Maxwell Lane, Kingston, NY, for a term of three (5) years, beginning November 15, 2020 and ending November 14, 2025, at an annual rental cost of $16,000.00, as filed with the Clerk of the Legislature or as modified with the approval of the County Attorney,
and move its adoption.
