Chairman of the Economic Development, Tourism, Housing, Planning, and Transit Committee, Brian B. Cahill, and Deputy Chair Herbert Litts, III offer the following:
WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Planning; and
WHEREAS, the Ulster County Legislature adopted Resolution No. 503 of 2017 thereby establishing Capital Project No. 479 for the design and right-of-way incidentals work for the Ulster County Midtown Linear Park (PIN 8761.82) in the City of Kingston (hereinafter the “Project”) and authorizing an agreement between the County of Ulster (hereinafter the “County”) and the New York State Department of Transportation (hereinafter “NYSDOT”) to fund engineering and right-of-way incidentals for the Project; and
WHEREAS, the Ulster County Legislature adopted Resolution No. 391 of 2019 pursuant to 6 NYCRR Part 617 et seq. of the Regulations of Article 8 of the Environmental Conservation Law of New York State (hereinafter “SEQRA”) thereby adopting and issuing a determination of non-significance under SEQRA (hereinafter the “Negative Declaration”); and
WHEREAS, the Ulster County Legislature adopted Resolution No. 540 of 2019 amending Capital Project 479 for right-of-way acquisition and authorizing a supplemental agreement between the County and NYSDOT to fund this Project phase; and
WHEREAS, pursuant to the funding agreements with NYSDOT, the County is advancing towards Project construction in fall 2020 and is required to obtain permanent trails easements from the City of Kingston for three street crossings at Downs Street, O’Neil Street and Cornell Street, which the City is willing to convey to the County to advance the Project; now, therefore be it
RESOLVED, the Ulster County Legislature hereby authorizes the Chair of the Ulster County Legislature to execute, on behalf of the County of Ulster, any and all agreements and documents related to the acquisition of the trail easements from the City of Kingston for construction and operation of the Ulster County Midtown Linear Park Project as approved by the County Attorney,
and move its adoption.
