Authorizing The Chair Of The Legislature To Call A Public Hearing As Required Under Article 25AA Of Agricultural Markets Law Regarding The 8-Year Review Of Agricultural District No. 3 And Providing Direct Notice To Affected Municipalities

Chairman of the Economic Development, Tourism, Housing, Planning, and Transit

Committee, James F. Maloney, and Deputy Chairman Hector Rodriguez offer the

following:

 

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Department of Planning; and

WHEREAS, New York State Department of Agriculture and Markets has

notified Ulster County that Agricultural District No. 3 in the Towns of Hardenburgh,

Marbletown, Olive, Rochester, Rosendale and Wawarsing is approaching its eightyear anniversary date of July 21, 2017, and

WHEREAS, Agricultural Markets Law Article 25AA requires the County to

cause a review of the District to be conducted and completed within 300 days, and,

WHEREAS, as part of the review, Agricultural Markets Law Article 25AA

requires a Public Hearing to be held concerning the review of the district and any

proposed modifications to the district, and,

WHEREAS, Agricultural Markets Law Article 25AA requires that the Public

Hearing be held between day 120 and day 180 of the 300 day Review, and,

WHEREAS, the Economic Development and Tourism Committee has met and

reviewed said request with a majority of the members voting approval, now,

therefore, be it

RESOLVED, that the Chair of the Legislature is authorized to call such Public

Hearing no later than March 23, 2017, and, be it further

RESOLVED, that the Clerk of the Ulster County Legislature shall cause a

legal notice of said Public Hearing to be published according to law, and, be it further

RESOLVED, that the Clerk of the Ulster County Legislature shall provide in

writing to all affected municipalities a copy of the hearing notice, 

 

and moves its adoption.
