Briggs, Maio, and Maloney)
Chairman of the Economic Development, Tourism, Housing, Planning, and Transit
Committee, James F. Maloney, and Deputy Chairman Hector S. Rodriguez offer the
following:
WHEREAS, this resolution has been offered by the County Executive on
behalf of the Department of Planning; and
WHEREAS, the Hudson Valley Rail Trail West: Phase 4 project (the
“Project”) will create a shared-use trail from New Paltz Road to South Street in the
Town of Lloyd extending the Hudson Valley Rail Trail (HVRT) westward towards
New Paltz and expanding the HVRT to approximately 5.5-miles upon completion of
the Town of Lloyd’s pending Phase 3 extension and the County’s Project; and
WHEREAS, the County was awarded competitive federal Transportation
Alternatives Program (TAP) funding for the Project and has received a Federal-Aid
Local Project Agreement for funding reimbursement for engineering, right-of-way
incidentals, and right-of way acquisition for the Project (PIN 8761.21); and
WHEREAS, pursuant to Resolution No. 139 of April 21, 2015, the Ulster
County Legislature established the Project and authorized engineering and right-ofway work totaling $175,000.00 ($140,000.00 Federal funds and $35,000.00 County
share); and
WHEREAS, pursuant to Resolution No. 45 of January 26, 2016, the Ulster
County Legislature adopted and issued a determination of non-significance (“Negative
Declaration”) under 6 NYCRR Part 617 of the Regulations of Article 8 of the
Environmental Conservation Law of New York State (“SEQRA”); and
WHEREAS, pursuant to Resolution No. 238 of April 19, 2016, the Ulster
County Legislature amended the Project to include right-of-way acquisition costs
estimated at $84,835.00 ($67,868.00 Federal funds and $16,967.00 County share);
and
WHEREAS, pursuant to Resolution No. 375 of August 16, 2016, the Ulster
County Legislature issued the Determination and Findings Statement related to the
public purpose and benefit of the Project; and
WHEREAS, the Capital Project needs to be increased to cover costs of
additional services for engineering and right-of-way services, which are necessary
due to required supplementary environmental reviews, additional wetland surveys,
expanded title research and right-of-way professional services; and therefore be it
RESOLVED, that Capital Project 451- Hudson Valley Rail Trail West: Phase
4- is hereby amended in the amount of $41,040.00 for professional services; and be it
further
RESOLVED, that the 2016 Ulster County Capital Fund Budget is hereby
amended as follows:
