Chairman of the Energy, Environment and Sustainability Committee, Chris Hewitt, Deputy Chair Richard Walls, and Legislator Corcoran offer the following:
WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Planning Department; and
WHEREAS, the City of Kingston has requested that the County share the cost of cleaning up petroleum contamination discovered on the border of the City of Kingston’s Dietz Stadium and Ulster County Department of Public Works properties while constructing the Dietz Stadium Improvements Project; and
WHERAS, Capital Project No. 629 - Ulster County Brownfields Program has been amended to include cleanup of funding from contamination associated with County owned properties; and
WHEREAS, the County and the City of Kingston desire to enter into an Intermunicipal Agreement with the City to provide Forty-six Thousand Three Hundred and Eighty ($46,380.00) Dollars of funds from Ulster County’s Capital Project No. 629, for the purpose of reimbursing the City for the cost of cleanup at the City’s Dietz Stadium property that may be associated with the adjoining Ulster County Highway Garage site; now, therefore be it
RESOLVED, the Ulster County Legislature hereby determines that the proposed action that the proposed action is a Type II Action under 6 NYCRR Part 617 of the State Environmental Quality Review Act (SEQRA) and does not pose a risk of significant environmental impact; and, be it further
RESOLVED, the Chair of the Ulster County Legislature is hereby authorized to execute the Intermunicipal Agreement with the City of Kingston to partially fund the cleanup costs on the border of Dietz Stadium and the Ulster County Department of Public Works property in the form as filed with the Clerk of the Legislature or as modified with the approval of the County Attorney,
and move its adoption.
