Chairman of the Energy, Environment and Sustainability Committee, Chris Hewitt, and Deputy Chair Richard Walls offer the following:

 

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Ulster County Department of the Environment; and

 

WHEREAS, the New York State Department of Environmental Conservation (DEC) Water Quality Improvement Project (WQIP) program has awarded Ulster County up to $250,000.00 for the Ulster County Aquatic Connectivity Restoration – Woodstock Culvert # 2 Road-Stream Crossing (RSX) replacement project, project number #118918; and

 

WHEREAS, the project involves replacing a deteriorating and undersized box culvert at the intersection of Wittenberg Road and Penny Lane in the Town of Woodstock, NY, which will alleviate frequent local flooding issues and connect approximately 2.2 miles of aquatic habitat in a tributary to the Sawkill Creek, including trout habitat; and

 

WHEREAS, the culvert will be replaced utilizing in-house engineering and labor; and

 

WHEREAS, the Ulster County Legislature has reviewed the grant award, project details, and the necessity of executing an intermunicipal agreement to carry out the project; and

 

WHEREAS, the Ulster County Legislature finds that entering into an intermunicipal agreement is in the best interest of the County and necessary for the successful implementation of the WQIP-funded project; and

 

 

 

 

WHEREAS, Resolution No. 197 dated April 18, 2023 established Capital Project No. 663 Woodstock Culvert #2 in the amount of $250,000 in order to accept this grant funding; and now, therefore, be it

 

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute an intermunicipal agreement for the Water Quality Improvement Project (WQIP) Program Grant Contract for the Ulster County Aquatic Connectivity Restoration – Woodstock Culvert # 2 project, in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney, 

and moves its adoption.
