Legislators Eric Stewart, Manna Jo Greene, and Laura Petit offer the following:
WHEREAS, the Ulster County Legislature passed Resolution Number 333 on August 17, 2021 creating a capital project entitled “ARP Infrastructure and Trails”, with an anticipated allocation in the amount of $6,000,000.00; and
WHEREAS, amending the 2022 - 2027 Capital Improvement Program to create a matching fund program for municipal water infrastructure improvements is currently being considered by the Ulster County Legislature via Resolution No. 96 of 2022; and
WHEREAS, the purpose of the ARPA is to support urgent COVID-19 response efforts to continue to decrease spread of the virus and bring the pandemic under control; and
WHEREAS, additionally, a purpose is to utilize federal American Rescue Plan Act (ARPA) funds for water and sewer infrastructure investments that assist economic development and affordable housing projects in Ulster County; and
WHEREAS, the ARPA further seeks to replace lost public sector revenue to strengthen support for vital public services and help retain jobs; and
WHEREAS, the ARPA seeks to address systemic public health and economic challenges that have contributed to the unequal impact of the pandemic; and
WHEREAS, in allocating the ARPA funding, the Ulster County Legislature intends to make fair investments that result in positive, long-term benefits for as many Ulster County communities as possible; and
WHEREAS, in 2018 the Ulster County Legislature passed Resolution No. 255 on June 19, 2018, extending a waterline from Route 213 and Berme Road in High Falls to SUNY Ulster with that line running down Leggett Road to both serve the then immediate needs of the college and allow for future extensions of that waterline; and
WHEREAS, this proposed extension of water infrastructure by the Town of Marbletown to Main Street, Stone Ridge/Route 209 would offer drinking water to residences and businesses located there and would allow for future business and housing development—including opportunities to build higher density affordable and senior housing in those areas; and
WHEREAS, phase one of this project is estimated to cost $3,000,000.00, with Ulster County providing up to 50% matching funds, not to exceed $1,500,000 in Ulster County ARPA funding; and
WHEREAS, ARPA funds from Ulster County would be utilized to help provide an extension of sewer and water infrastructure from Leggett Road south of Lucas Avenue to Emmanuel’s Plaza shopping center on Main Street/Route 209 just north of Route 213; and
WHEREAS, the project will be constructed and maintained by the Town of Marbletown; and
WHEREAS, it is now desired to establish Capital Project No. 633 for the purpose of the Marbletown water infrastructure expansion in the amount of $1,500,000; now, therefore, be it
RESOLVED, that Capital Project No. 633 is hereby established as follows:

RESOLVED, the 2022 Ulster County Capital Fund is hereby amended as follows:

and, be it further
RESOLVED, that funding of the Capital Project established by this Resolution, and any contracts in excess of $50,000 or contract amendments which cause such contracts to exceed the aggregate sum of $50,000, made in connection with such Capital Project, shall be subject to the further approval of the Ulster County Legislature,
and move its adoption.
