Chairman of the Economic Development, Tourism, Housing, Planning, and Transit Committee, Hector S. Rodriguez, and Deputy Chair Brian Woltman offer the following:

 

WHEREAS, pursuant to Resolution No. 187 passed on May 19, 2015, the Ulster County Legislature authorized the County Executive and Chairman of the Legislature to execute a memorandum of agreement with the City of New York (the “MOA”) to accept grant funding for and facilitate creation of a public recreational trail along the Ashokan Reservoir (the “Ashokan Rail Trail”), which the County is currently constructing and anticipates completing by the end of 2019; and

 

WHEREAS, pursuant to the MOA, the City of New York and its Department of Environmental Protection (the “NYC DEP”) shall fund, design, construct, operate and maintain three public trailheads for the Ashokan Rail Trail; and

 

WHEREAS, the County and City have determined that it would be more economical, efficient, and advantageous for coordinated completion of the Ashokan Rail Trail if the construction of two of the three trailheads to be located at the Ashokan Station in Shokan and at the Woodstock Dike Fishing Area in West Hurley is completed by the County, utilizing approximately $1,880,400.00 in additional grant funding from the NYC DEP, which, according to County and City estimates, is sufficient to cover all expected design, bidding, construction and construction inspection costs (including significant contingency funding) for the two trailheads; and

 

WHEREAS, the County and City wish to amend the terms of the MOA to accomplish this change in their respective obligations in connection with the construction of the two aforementioned trailheads with additional funding from the NYC DEP; and now, therefore, be it 

 

 

 

 

 

 

 RESOLVED, that the Ulster County Legislature hereby authorizes the County Executive and Chair of the Ulster County Legislature to execute an Amendment to the Memorandum of Agreement executed on June 16, 2015 between the City of New York and Ulster County (County Contract No. 2015-416) to allow the County to construct two trailheads with additional NYC DEP funding,

 

and move its adoption.
