Chairwoman of the Public Works and Capital Projects Committee, Laura Petit, and Deputy Chair Dean J. Fabiano offer the following:

 

          WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Public Works; and

 

WHEREAS, a project for shoulder widening and reconstruction on Route 299 (County Route 7 & 8) from Libertyville Road to Route 44/55 in the Town of New Paltz and Gardiner, PIN 8051.11 (the “Project”) may be eligible for funding under Title 23 of the United States Code, as amended, that calls for the apportionment of the costs of such program to be borne at the ratio of 80% federal funds, 20% non-federal funds; and

 

WHEREAS, the Project will help improve the safety of motorists, bicyclists, pedestrians and other users of this segment of Route 299; and

 

WHEREAS, pursuant to Resolution No. 545, dated December 20, 2016, Capital Project No. 488 was established in an amount of $487,000.00 to provide authorization and funding for preliminary engineering at $312,000.00 and right-of-way incidental work at $175,000.00 for the Project; and

 

WHEREAS, Resolution No. 142, dated April 17, 2018, amended Capital Project No. 488 for the additional preliminary engineering, right-of-way work and construction inspection for the Project in the amount of $262,397.00, of which such costs may be reimbursable up to 80% with federal funds, bringing the total project cost to $749,397.00; and

 

WHEREAS, Resolution No. 310, dated July 17, 2018, declared the intent of the Ulster County Legislature to serve as SEQRA Lead Agency for an Unlisted Action and amended Capital Project No. 488 for additional engineering services in the amount of $35,000.00, bringing the total cost of the project to $784,397.00; and

 

 

 

WHEREAS, during preliminary engineering and review, it has been determined that the Project constitutes a Type I action under 6 NYCRR 617.4(b), requiring modification to the Unlisted Action as previously determined from Resolution No. 310 dated July 17, 2018; now, therefore, be it

 

RESOLVED, that the Ulster County Legislature has determined, after review of the criteria contained in 6 NYCRR Parts 617.4 (b) that the Project is a Type I Action; and, be it further

 

RESOLVED, that pursuant to 6 NYCRR Part 617.6(b) (3) of the Regulations pertaining to Article 8 of the Environmental Conservation Law of New York State (SEQRA), the Ulster County Legislature hereby declares its intent to serve as Lead Agency for the Project; and, be it further

 

RESOLVED, that the Ulster County Legislature will conduct a coordinated review and circulate its Notice of Intent to serve as Lead Agency, together with the EAF and accompanying documentation to all interested and involved agencies pursuant to 6 NYCRR Part 617.6(b) (2) (i) and 6 NYCRR Part 617.6(b) (3); and, be it further

 

RESOLVED, that pursuant to 6 NYCRR Part 617.6(b) (3), at the conclusion of an otherwise unchallenged thirty (30) day period following the date of transmittal of the Notice of Intent, the EAF and documentation aforesaid to the interested agencies, the Legislature shall become the Lead Agency under SEQRA for this project,

 

and move its adoption.
