Chairman of the Legislative Programs, Education and Community Services Committee, James Delaune, and Deputy Chair Heidi Haynes, offer the following:

 

WHEREAS, this resolution has been submitted by the County Executive on behalf of the Veteran Services Agency; and

 

            WHEREAS, the approved 2019 – 2024 Capital Improvement Program includes a project “Veteran’s Cemetery” in the amount of $820,000.00 to construct the cemetery expansion and improvements; and

 

WHEREAS, pursuant to Resolution No. 468 of November 20, 2018, the County established Capital Project No. 528 and provided funding for planning expenses with regard to expansion and improvements at the Veterans Cemetery located on Plains Road in the Town/Village of New Paltz to include walkways, hardscaping, and a committal shelter in the amount of $110,000.00; and

 

WHEREAS, additional funds are necessary to conduct the studies needed to comply with the New York State Environmental Quality Review Act (6 NYCRR Part 617, SEQRA) as well as to obtain state and local regulatory approvals not included in the original project design scope; and

 

WHEREAS, the County wishes to establish itself as lead agency and conduct a coordinated review as provided for in 6 NYCRR Part 617.6 of SEQRA; and

 

WHEREAS, the project planning and design constitutes a Type II action under section 2.7 of the County of Ulster’s State Environmental Quality Review Act (SEQRA) Type II List that was adopted by Resolution No. 118 on April 20, 2010; now, therefore, be it

           

           

 

 

 

RESOLVED, that the Ulster County Legislature has determined, after review of the criteria contained in 6 NYCRR Parts 617.4, that the expansion and improvement of the Veterans Cemetery to be located on Plains Road in the Town/Village of New Paltz is an Unlisted Action; and, be it further

 

RESOLVED, that the Ulster County Legislature will conduct a coordinated review and circulate its Notice of Intent to serve as Lead Agency, together with the Environmental Assessment Form (“EAF”) and accompanying documentation to all interested and involved agencies pursuant to 6 NYCRR Part 617.6(b) (2) (i) and 6 NYCRR Part 617.6(b) (3); and, be it further

 

RESOLVED, that pursuant to 6 NYCRR Part 617.6(b) (3), at the conclusion of an otherwise unchallenged thirty (30) day period following the date of transmittal of the Notice of Intent, the EAF, and accompanying documentation to the interested agencies, the Legislature shall become the Lead Agency under SEQRA for this project; and, be it further

 

RESOLVED, that the 2019 Ulster County Capital Fund is hereby amended as follows:
