Chairman of the Economic Development, Tourism, Housing, Planning, and Transit Committee, Hector S. Rodriguez, and Deputy Chair Brian Woltman offer the following:

 

WHEREAS, this resolution has been submitted by the Acting County Executive on behalf of the Department of Planning; and

 

WHEREAS, an abutting landowner of lands originally purchased for highway purposes in the Town of Wawarsing, Hamlet of Napanoch, located on a portion of US Route 209 – SH No. 141 in the Town of Wawarsing as depicted on Map No. 42.5 (the “Subject Property”), has requested that the Subject Property be considered no longer needed or useful for such highway purposes; and 

 

WHEREAS, the New York State Department of Transportation (“NYSDOT”) has maintenance jurisdiction over the Subject Property; and 

 

WHEREAS, NYSDOT has determined that a portion of the Subject Property, as depicted in the “Aerial GIS MAP & Sketch of Request Area,” can be released from NYSDOT maintenance jurisdiction, as that portion of Subject Property is no longer needed or useful for highway purposes; and 

 

WHEREAS, pursuant to Section 10(32) of New York State Highway Law, where the NY State Commissioner of Transportation (the “Commissioner”) deems an existing state highway or portion thereof to be no longer needed or useful to the state highway system, the Commissioner, upon the request of a municipality, has the authority to abandon such existing state highway or portion thereof; and

 

WHEREAS, upon such abandonment, pursuant to Section 10(32) of New York State Highway Law, the Subject Property would be turned over to Ulster County; now, therefore, be it

 

 

 

 

 

RESOLVED, the Chair of the Ulster County Legislature is hereby authorized to request that the Commissioner abandon the portion of the Subject Property depicted in the “Aerial GIS MAP & Sketch of Request Area;”,

 

and move its adoption.
