Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano,

Deputy Chair Manna Jo Greene, and Legislators Litts and Nolan offer the following:

WHEREAS, this Resolution has been submitted by the County Executive on

behalf of the Department of Public Works; and

 

WHEREAS, the County of Ulster is in the process of planning the

reconstruction of New Paltz Road at the intersection of South Chodikee Lake Road in

the Town of Lloyd in order to improve the sight distance for drivers at that

intersection; and

 

WHEREAS, the 2018-2023 Ulster County Capital Improvement Program

includes funding of $500,000 for such project; and

WHEREAS, the County originally determined the project scope for road

alignment to be a Type II Action under the provisions of the State Environmental

Quality Review Act, 6 NYCRR Part 617 (SEQRA) which did not require additional

environmental review; and

WHEREAS, subsequently the County has decided to move forward with a

project alternative requiring the acquisition and demolition of a structure satisfying

project goals at a significant cost savings; and

WHEREAS, a short form Environmental Assessment Form (SEAF) was

completed for the revised project documenting potential environmental, historic and

cultural impacts of the project and proposed avoidance, minimization and mitigation

measures; and

WHEREAS, the State Historic Preservation Office (SHPO) has reviewed the

proposed demolition of the structure and determined that is would not have adverse

effect on historic resources; now, therefore be it 

 

RESOLVED, that the Ulster County Legislature, after review of the SEAF

and the SHPO letter of no adverse effect, has determined that the implementation of

Capital Project No. 501 constitutes an Unlisted Action under 6 NYCRR Part 617

(SEQRA) and will not have a significant adverse impact on the environment; and be

it further

RESOLVED, that the Chairman of the Ulster County Legislature is authorized

to execute the SEAF and file it with the Capital Project #501 File in compliance with

the provisions of SEQRA,

and move its adoption.
