Referred to: The Public Works and Capital Projects Committee (Chair Nolan and Legislators Donaldson, Kovacs, Litts, and McCollough), and The Ways and Means Committee (Chairman Gavaris and Legislators Collins, Hansut, Kovacs, Nolan, Roberts, and Uchitelle)
Chair of the Public Works and Capital Projects Committee, Kathy Nolan, and Deputy Chair Herbert Litts, III offer the following:
WHEREAS, the Adopted 2025 – 2030 Capital Improvement Program includes $300,000.00 for the Banjo Bridge (BIN# 3346470) in the Town of Rochester for fiscal year 2025; and
WHEREAS, the Adopted 2025 – 2030 Capital Improvement Program includes $225,000.00 for the Sully Bridge (BIN# 3347710) in the Town of Woodstock for fiscal year 2025; and
WHEREAS, Capital Project No. 712 – Sully Bridge, Town of Woodstock and Capital Project No 713 – Banjo Bridge, Town of Rochester were established pursuant to Resolution No. 581 of November 19, 2024 in the amounts of $525,000.00 $225,000.00 and $300,000, respectively; and
WHEREAS, the Department of Public Works desires to amend the two bridge projects due to unanticipated costs for bridge construction materials; and
WHEREAS, pursuant to Resolution No. 689 of December 17, 2024, a Restricted Capital Reserve - Bridge Capital Reserve (“The Fund”) was established for Bridge projects in the amount of $10,000,000.00; and
WHEREAS, pursuant to Resolution No. 689 of December 17, 2024, monies in The Fund may be appropriated to finance costs of bridge projects to protect taxpayers from unsustainable and unpredictable fluctuations in the costs of construction, reconstruction, or acquisition of such capital improvements; and
WHEREAS, an expenditure shall be made from The Fund only by recommendation of the Executive andauthorization of the Legislature for any object or purpose for the construction, reconstruction, or acquisition of county-owned bridge capital improvements for which bonds may be issued; and
WHEREAS, the County Executive recommends the use of the Restricted Capital Reserve – Bridge Capital Reserve for the construction expenditures of the aforementioned County-owned bridges; now, therefore be it
RESOLVED, based upon examination by the Ulster County Legislature, the County’s funding of this Project constitutes a Type II action as defined under Sections 4.5.5 of the County of Ulster’s State Environmental Quality Review Act (SEQRA) Type II List, which was adopted pursuant to Resolution No. 118 dated April 20, 2010; and, be it further
RESOLVED, Ulster County has determined that this funding action does not pose a significant potential environmental impact and may be progressed as a Type II action in accordance with 6 NYCRR Part 617 of SEQRA, and does not require any further determination or procedure under SEQRA; and, be it further
RESOLVED, that the 2025 Ulster County Operating Budget is hereby amended as follows:
