Referred to: The Law Enforcement and Public Safety Committee (Chairwoman Eckert and Legislators Collins, Haynes, Heppner, and Ronk), and The Ways and Means Committee (Chairwoman Archer and Legislators Gerentine, Maio, James Maloney, Joseph Maloney, Petit, and Rodriguez)
Chairwoman of the Law Enforcement and Public Safety Committee, Lynn Eckert, and Deputy Chair Kenneth Ronk, Jr. offer the following:
WHEREAS, this resolution has been submitted by the Ulster County District Attorney (the “District Attorney”); and
WHEREAS, the District Attorney has been awarded funding in the amount of $143,600.00 by the New York State Division of Criminal Justice Services (DCJS) for participation in the Crimes Against Revenue Program (CARP) for the term January 1, 2019 through December 31, 2019; and
WHEREAS, the funds will be used exclusively to continue to fund a designated Assistant District Attorney to specialize in the investigation and prosecution of revenue crimes against New York State committed within Ulster County; and forensic accounting services to assess, identify evidence, review documentation and provide testimony if necessary, on a case by case basis during the prosecution of revenue crimes against New York State committed within Ulster County; and
WHEREAS, the District Attorney requests that the Chair of the Ulster County Legislature be authorized to execute an agreement (NYS Contract No. C445142) with DCJS for participation in CARP for the term beginning January 1, 2019 and ending December 31, 2019 in the amount of $143,600.00; now, therefore, be it
RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute an agreement and any related amendments with DCJS (NYS Contract No. C445142) in the amount of $143,600.00 for the term beginning January 1, 2019 and ending December 31, 2019, in the form as filed with the Clerk of the Ulster County Legislature, or as modified with the approval of the County Attorney, in consultation with Counsel to the County Legislature, Chair of the County Legislature, and the Chair and Deputy Chair of the Law Enforcement and Public Safety Committee; and be it further
RESOLVED, that if funding for this program is eliminated, the program/position will be eliminated as well,
and move its adoption.
