Referred to: The Public Works and Capital Projects Committee (Chairman Fabiano
and Legislators Greene, Litts, Nolan, and Roberts), and The Ways and Means
Committee (Chairman Gerentine and Legislators Archer, Bartels, Lopez, James
Maloney, Joseph Maloney, and Petit)
Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and
Deputy Chair Manna Jo Greene offer the following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Department of Public Works; and
WHEREAS, an existing turn on Frost Valley Road, in the Town of Denning,
is continually damaged during flood events; and
WHEREAS, the approved 2018 – 2023 Capital Improvement Program
includes a project “Frost Valley – Big Turn – Reconstruction” in the amount of
$1,880,000.00 for the project; and
WHEREAS, Resolution No. 267 dated June 20, 2017 established Capital
Project 504 Frost Valley Road S-Turn Project in the amount of $230,000.00 for
construction inspection and right-of-way, and determined that the Project constituted
an Unlisted Action under the New York State Environmental Quality Review Act
(SEQRA) 6 NYCRR Part 617.6; and
WHEREAS, Resolution No. 144 dated April 17, 2018 authorized land
acquisition for such Project; and
WHEREAS, Ulster County has been awarded a grant in the amount of
$5
WHEREAS, it is now necessary to fund the construction phase of Capital
Project No. 504 in the amount of $1,650,000.00; now, therefore, be it
RESOLVED, that Ulster County Legislature upon review of the
Environmental Assessment form and the NYSDEC permits issued for the project as
filed with the Clerk of the Legislature, has determined that the Project will not have
a significant adverse environmental impact and adopts and issues a negative
declaration in accordance with 6 NYCRR Part 617.7 of SEQRA to be filed with the
Project; and, be it further
RESOLVED, the Ulster County Legislature hereby authorizes the Chairman
of the Ulster County Legislature to execute an agreement with the Sullivan County
Soil & Water Conservation District as lead agency of the New York City Department
of Environmental Protection (NYCDEP) funded “Rondout Neversink Stream
Program” on behalf of the County of Ulster, any and all documents related to grant
proceeds as approved by the County Attorney; and, be it further
RESOLVED, that the 2018 Ulster County Budget is hereby amended as
follows:
