Deputy Chair of the Public Health & Social Services Committee, Jeanette

Provenzano, Chair of the Laws & Rules, Governmental Services Committee, Richard

Parete, Deputy Chair Kevin Roberts, and Legislator Belfiglio offer the following:

WHEREAS, a public hearing is required to be held regarding Proposed Local

Law No. 14 of 2014 (A Local Law Of The County Of Ulster, New York, entitled

“The Ulster County Tobacco Licensing and Reduced Youth Exposure to Tobacco”),

a public hearing will be held on Tuesday, March 17, 2015 at 7:00 PM in the

Legislative Chambers, Ulster County Office Building, 6th Floor, 244 Fair Street,

Kingston, New York; now, therefore, be it

RESOLVED, said Proposed Local Law No. 14 of 2014 is hereby submitted to

the Ulster County Legislature and is hereby tabled pending the holding of a public

hearing thereon; and, be it further

RESOLVED, that the Clerk of the Ulster County Legislature shall cause a

legal notice of said public hearing to be published according to law; and, be it further

RESOLVED, that said public hearing will be held on Tuesday, March 17,

2015 at 7:00 PM in the Legislative Chambers, Ulster County Office Building, 6th

Floor, 244 Fair Street, Kingston, New York,

and move its adoption.

Legislator Richard Parete motioned, seconded by Legislator Provenzano, to amend

Proposed Local Law No. 14 of 2014 to add (I) to Section 4 to read as follows:

“(I) Within thirty (30) days of receiving a completed application and supporting

documentation, if any, the Commissioner must either grant or deny the

applicant’s request for a Tobacco Retail License and must notify the applicant

of his or her determination. If the applicant is an Existing Tobacco Retailer,

the retailer may continue to engage in the sale of Tobacco Products until such

time as a determination is made by the Commissioner and the retailer receives

notification of such determination. If the applicant is applying for a New

Tobacco Retail License and was not in existence prior to January 1, 2016, the

applicant may not begin selling Tobacco Products until he or she receives

notification of the Commissioner’s determination.”
