Chair of the Public Works and Capital Projects Committee, Kathy Nolan, and Deputy Chair Herbert Litts, III offer the following:
WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Department of Public Works; and
WHEREAS, the counties and cities are required by law to furnish and maintain adequate court facilities for use by the trial courts of the State of New York; and
WHEREAS, Chapter 686 of the Laws of 1996 was enacted to invest the State of New York with the fiscal responsibility of managing the interior cleaning of court facilities and the performance of minor repairs therein, and with the ability to cover the costs thereof; and
WHEREAS, Chapter 686 of the Laws of 1996 requires the State of New York to contract with political subdivisions of the State for the cleaning of court facilities, as well as minor and emergency repairs; and
WHEREAS, the County of Ulster is responsible for furnishing and maintaining the Ulster County Courthouse, the Ulster County Family Court, the Ulster County Hall of Records, and the Surrogate’s Court in the Ulster County Office Building; and
WHEREAS, said contract with the New York State Unified Court System provides reimbursement to the County of Ulster for costs expended in the provision of services pursuant to agreement for the term beginning April 1, 2023 for a maximum of five years through March 31, 2028; and
WHEREAS, the Ulster County Legislature passed Resolution 142 of 2024, authorizing the Chair to execute an agreement with the New York State Unified Court System for the aforementioned services in the amount of $601,463.00; and
WHEREAS, the New York State Unified Court System has since informed the Department of Public Works that the amount budgeted for the agreement is significantly lower than the originally stated amount; and
WHEREAS, no revenue has been received pursuant to Resolution No. 142 of 2024; and
WHEREAS, Commissioner of Public Works has requested the repeal Resolution 142 of 2024, and authorization of the Chair of the Ulster County Legislature to execute a new agreement with the New York State Unified Court System for reimbursement attributed to the aforementioned services in the amount of $286,465.00 for the initial term of April 1, 2023 through March 31, 2024; now, therefore, be it
RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute an agreement with the New York State Unified Court System, for the initial term beginning April 1, 2023 and ending March 31, 2024, for reimbursement for cleaning and for minor and emergency repairs of court facilities, in a proposed contract amount of $286,465.00 for the year, in the form as filed with the Clerk of the Legislature or as modified with the approval of the County Attorney,
and moves its adoption.
