Chairman of the Energy, Environment and Sustainability Committee, Chris Hewitt, and Deputy Chair Richard Walls offer the following:

 

WHEREAS, this Resolution has been submitted at the request of the County Executive on behalf of the Department of Planning; and

 

WHEREAS, pursuant to Resolution No. 544 of November 15, 2022 the Ulster County Legislature established Capital Project No. 648 Ulster and Delaware (U&D) Corridor Rail Trail (the Project) and determined that the Project was an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law of New York State (SEQRA); and

 

WHEREAS, during the design process for the Project coordination with the New York State Office of Parks and Recreation, the State Historic Preservation Office (SHPO) determined that this section of U&D Corridor was eligible for listing on the National Register of Historic Places; and

 

WHEREAS, such determination would change the categorization of the Project from an Unlisted Action under SEQRA to a Type I Action; and

 

WHEREAS, as a Type I action under SEQRA a revised full environmental assessment form (FEAF) and circulation to involved agencies is required under SEQRA; now, therefore be it

 

RESOLVED, that the Ulster County Legislature has determined, in accordance with SHPO’s decision concerning the eligibility of U&D Corridor for listing on the National Register of Historic Places and the criteria contained in 6 NYCRR Parts 617.4 that the Project is hereby classified as a Type I Action; and, be it further

 

RESOLVED, that the Ulster County Legislature acting as lead agency will circulate the FEAF and accompanying documentation to all interested agencies pursuant to 6 NYCRR Part 617.6(b) (2) (i) and 6 NYCRR Part 617.6(b) (3),    

 

 

 

and moves its adoption.
