Chair of the Health, Human Services and Housing Committee, Abe Uchitelle, and Deputy Chair Craig V. Lopez offer the following:

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Ulster County Department of Mental Health; and

WHEREAS, the Criminal Court Program is mandated under New York State Mental Hygiene Law Section 43.03 where 100% of the cost of care for Criminal Procedure Law Section 730 and Correction Law Section 508 individuals is the sole responsibility of the county; and

WHEREAS, the charges by the New York State Office of Mental Health (OMH) are for the cost of inpatient care in a State-operated psychiatric facility for individuals who are found to be incompetent and ordered by a court to be evaluated and/or treated; and

            WHEREAS, the Ulster County Department of Mental Health has received notification from the New York State Office of Mental Health (OMH) for costs for the care of Section 730 and Section 508 defendants in state operated forensic facilities that are expected to exceed the current annual departmental budget; and 

            WHEREAS, to enable the payment of the costs, an amendment of the 2023 budget is necessary; now, therefore, be it

RESOLVED, that the 2023 Ulster County Operating Budget is hereby amended as follows:
