Chairwoman of the Public Works, Capital Projects and Transportation Committee, Laura Petit, and Deputy Chair Dean Fabiano offer the following:

 

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Department of Public Works; and

 

WHEREAS, Sections 133-A, 135, and 135-A of Article 6 of the New York State Highway Law provide authorization for the County to execute intermunicipal agreements with towns for the maintenance of County roads and for the County to lease its highway machinery, tools or equipment to towns for the purpose of maintaining County roads, subject to approval by resolution of both the Ulster County Legislature and the respective town board; and

 

WHEREAS, some County roads are so located that it is more efficient for towns to perform summer light maintenance, snow plowing, sanding and salting of the roads, thereby greatly decreasing the cost to the County of the road maintenance performed; and

 

WHEREAS, a 6.2-mile length of County Road 102, and a 3.77-mile length of County Road 7A, and a 1.73-mile length of County Road 145, all in the Town of Hardenburgh, are so located that it would be more efficient for the Town of Hardenburgh to maintain them; and

 

WHEREAS, the Ulster County Commissioner of Public Works has requested that the Chair of the Ulster County Legislature be authorized to execute an Intermunicipal Shared Services Agreement with the Town of Hardenburgh for the Town to perform winter light maintenance, snow plowing, sanding, and salting on these roads, and cleaning culverts when necessary, cutting brush, and repairing potholes during the summer months, which total 11.7 centerline miles, for a term of three (3) years commencing October 1, 2023 through September 30, 2026 for a not to exceed annual fee of $108,531.68 for 2024, $110,702.87 for 2025, and $$112,916.55 for 2026; and;

 

 

 

WHEREAS, as part of the agreement, the County will further compensate the Town, based on the number of centerline miles, a performance incentive in the amount of $3,971.88 first year and an annual escalation fee of 2% annually for the term of the agreement; now, therefore, be it

 

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute and Intermunicipal Shared Services Agreement, and any amendments thereto, with the Town of Hardenburgh for performance by the Town of summer light maintenance, snow plowing, sanding and salting of a 6.2-mile length of County Road 102, and a 3.77-mile length of County Road 7A, and a 1.73-mile length of County Road 145, for the period October 1, 2023 through September 30, 2026, in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney; and, be it further

 

RESOLVED, that if funding for this program is eliminated then the program will be eliminated as well,        

 

and moves its adoption.
