Chairman of the Economic Development, Planning, Education, Employment, Arts and Agriculture Committee, Brian B. Cahill, and Deputy Chair Herbert Litts, III offer the following:

 

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Veterans’ Service Agency; and

 

WHEREAS, Pursuant to Resolution No. 468 of November 20, 2018 the Ulster County Legislature established Capital Project 528 for the development of a Veterans’ Cemetery to be located at 381 Plains Road able to serve all of the veterans in Ulster County (the “Project”) with funding included for the necessary engineering and design services for the Project; and

 

WHEREAS, pursuant to Resolution No. 147 of March 2022 the Ulster County Legislature adopted and issued a negative declaration under NYCRR Part 617 State Environmental Quality Review Act for the construction of said Veterans’ Cemetery; and

 

 WHEREAS, pursuant to Resolution No, 256 of May 2022, the Ulster County Legislature provided the necessary funding to construct the Veterans’ Cemetery; and

 

WHEREAS, during the construction of the Veterans’ Cemetery it was determined, in cooperation with the Village of New Paltz, that water supply for irrigation of the lands of the Cemetery was available from the Village; and

 

WHEREAS, as part of the installation of the water supply system, Ulster County in cooperation with the Village of New Paltz, identified areas of the Village Code as it relates to water supply would be burdensome to the County and that relief from these requirements would not constitute a risk to the Village Water Supply nor created a precedent for others to seek such relief due to the unique nature of the Veterans’ Cemetery Project and its water supply needs; and

 

WHEREAS, the Village has requested that the County enter into a Memorandum of Agreement to provide water to the Veterans’ Cemetery; now, therefore, be it

 

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to enter into a Memorandum of Agreement with between Ulster County and Village of New Paltz to secure the necessary water supply for irrigation purposes for the Veterans’ Cemetery in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney and Legislative Counsel,

 

and move its adoption.
