Chairwoman of the Public Works, Capital Projects and Transportation Committee, Laura Petit, and Deputy Chair Dean Fabiano offer the following:

 

WHEREAS this resolution has been submitted at the request of the County Executive on behalf of the Department of Public Works; and

 

WHEREAS, the Sheriff Michael LaPaglia Memorial Bridge, which is commonly referred to as Phoenicia Bridge (County Bridge 191, BIN 334780), carries Bridge Street (CR 40) over the Esopus Creek, connecting Main Street in the Hamlet of Phoenicia Town of Shandaken to State Route 28 is a county-owned asset; and

 

WHEREAS this project intends to evaluate structure alternatives for replacement; a topographic survey, hydraulic design, consideration of water main on the existing bridge, and the associated impacts on stream hydraulics during high flow flooding events of the Esopus Creek; and

 

WHEREAS, pursuant to Resolution No. 275 of 2014, any removal of rail within the U&D Corridor requires approval of the Ulster County Legislature; and

 

WHEREAS, a section of the U&D totaling no more than five hundred (500) feet; three hundred (300’) feet east and two-hundred feet (200’) west, of the Bridge needs to be removed in order to allow the construction of the new bridge to sustain a 100-year flood event and maintain a vital connection between Phoenicia and Route 28; and

 

WHEREAS, any rail removed pursuant to this resolution shall remain the property of Ulster County and shall be stored in a location just north of the removal; now, therefore be it

 

RESOLVED, that the Ulster County Legislature hereby authorizes the removal of up to five hundred (500) feet of rail and to allow the necessary work within the County’s railroad right of way,

 

and move its adoption.
