Chairman of the Legislative Programs, Education and Community Services Committee, James Delaune, and Deputy Chair Heidi Haynes, offer the following:

 

            WHEREAS, performing arts are an important component of our cultural heritage, and the many performances arranged by the Ulster Performing Arts Center (UPAC) attract Hudson Valley residents as well as travelers to see a broad range of entertainment for the community; and

 

WHEREAS, pursuant to County Law Section 224 (13), the Ulster County Legislature appropriated to UPAC the sum of $24,750.00 earmarked in the Contingent Account in the 2019 Ulster County Budget for the maintenance of facilities; and

 

            WHEREAS, pursuant to County Law Section 224 (13), in order to receive such funds, UPAC must submit to the Ulster County Legislature a verified accounting of disbursements to be undertaken, and to the Legislative Financial Analyst and Commissioner of Finance, a Memorandum of Receipt signed by the principal officer; and

 

WHEREAS, UPAC will receive payments totaling the amount of $24,750.00, in accordance with the terms specified in an agreement with the County of Ulster and UPAC, and no later than December 31, 2019, UPAC shall submit a certified accounting of expenditures to the Legislative Financial Analyst and Commissioner of Finance; now, therefore, be it

 

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute an agreement in the amount of $24,750.00, for the maintenance of facilities for UPAC, in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney, Counsel to the County Legislature, Chair of the County Legislature, and the Chair and Deputy Chair of the Legislative Programs, Education and Community Services Committee; and, be it further

 

 

 

 

RESOLVED, that as part of the agreement, the Comptroller and/or any and all officers of the County of Ulster, their agents and repre­sentatives, shall be allowed full access upon reasonable notice and at reasonable times to the books, papers, records and premises of UPAC, during the period that this resolution is in effect for the purpose of ascertaining the manner in which the above sum of money is being used or applied; and, be it further

 

RESOLVED, that the above organization agrees to comply with all applicable Federal, State and local regulations including, in particular, any forbidding discrimination by such organization; and, be it further

 

RESOLVED, that the 2019 Ulster County Budget is hereby amended as follows:
