Charwoman Tracey A. Bartels offers the following:

 

WHEREAS, on February 10, 2019, County Executive Michael P. Hein resigned from the position of Executive, thereby creating a vacancy in the office of County Executive; and

 

WHEREAS, pursuant to Charter on February 11, 2019, Adele B. Reiter, the designee as established in Executive Hein’s Order of Succession, was sworn in as Acting County Executive pursuant to Charter § C-29(C); and

 

WHEREAS, pursuant to Charter §C-29(C), the Acting County Executive shall serve in such capacity only until the vacancy is filled in accordance with Charter § C-29(D)(E) and (F); and

 

WHEREAS, the office of County Executive was vacated more than 180 days prior to the November 2019 General Election; and

 

WHEREAS, pursuant to Charter § C-29(D) such vacancy in the office of County Executive “shall be filled for the remainder of the unexpired term by a special election to be held no later than 90 days from the date the vacancy occurs”; and

 

WHEREAS, pursuant to Charter § C-29(D), the cost of such Special Election shall be borne by Ulster County; and

 

WHEREAS, the Ulster County Legislature, as the legislative, appropriating and policy-determining body of Ulster County, is empowered by the Charter to call for such a special election; now, therefore be it

 

RESOLVED, that a special election to fill the position of Ulster County Executive shall be held on April 30, 2019, a date which is less than 90 days from the effective date of the creation of the said vacancy; and, be it further

 

RESOLVED, that the Clerk of the Ulster County Legislature shall deliver a certified copy of this Resolution to the Ulster County Board of Elections in furtherance of the Board’s duty under Charter § C-29(D) to prepare ballots, voting machines and other matters so that such election may be duly held and conducted,
