Chairwoman of the Legislature, Tracey A. Bartels and Legislator Manna Jo Greene offer the following:

 

WHEREAS, Resolution No. 272 dated September 17, 2019, set the date for the Public Hearing on Proposed Local Law No. 5 of 2019 (A Local Law Amending The Code Of The County Of Ulster To Include Mandatory Food Scraps Composting By Large Generators), to be held on Thursday, October 10, 2019 at 6:15 PM in the Legislative Chambers, Ulster County Office Building, 244 Fair Street, Kingston, New York; and

 

WHEREAS, said Public Hearing was held on Thursday, October 10, 2019 at 6:15 PM in the Legislative Chambers, Ulster County Office Building, 244 Fair Street, Kingston, New York; and

 

WHEREAS, said Public Hearing was advertised in the official newspapers of the County of Ulster, and posted on the signboard maintained by the Clerk of the Legislature situated in the Ulster County Office Building; and

 

WHEREAS, all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to the Proposed Local Law; and

 

WHEREAS, the Legislature originally voted to adopt Proposed Local Law No. 5 on November 19, 2019; and

 

WHEREAS, the State Environmental Quality Review Act (SEQRA; ECL Article 8) requires agencies to review the prospective adverse environmental impacts of their actions prior to undertaking their actions; and

 

WHEREAS, the Legislature has prepared an environmental assessment form pursuant to the SEQRA regulations; and

 

WHEREAS, the Legislature has considered the prospective impacts of the proposed action consisting of the approval of Local Law 5 in light of the criteria for significance in 6 NYCRR § 617.7; and

 

 

 

 

WHEREAS the Legislature has determined that the adoption of Proposed Local Law No. 5 will not have any significant adverse environmental impact; now, therefore, be it

 

RESOLVED, that the Ulster County Legislature upon review of the Environmental Record, the Proposed Local Law No. 5 itself, and in accordance with the and criteria under 6 NYCRR § 617.7 determines that approval of Proposed Local Law No. 5 constitutes an Unlisted Action under SEQRA, and further finds that its approval will not have an significant adverse impact on the environment, and hereby authorizes the issuance of a negative declaration as filed with the Clerk of the Legislature; and, be it further

 

RESOLVED, that Resolution No. 444 dated November 19, 2019 is hereby repealed; and be it further

 

RESOLVED, that herein, Proposed Local Law No. 5 of 2019 is hereby adopted by the Ulster County Legislature, and, pending the approval of the County Executive, will be assigned a local law number consecutive to the last local law adopted and approved in 2019,

 

and move its adoption.
