Referred to: The Law Enforcement and Public Safety Committee (Chairwoman
Maio and Legislators Collins, Eckert, Fabiano, and Haynes)
Chairwoman of the Law Enforcement and Public Safety Committee, Mary Beth
Maio, and Deputy Chair Julius Collins offer the following:
WHEREAS, the Ulster County Sheriff’s Office is from time to time
responsible for the custody and care of prisoners who require treatment and
hospitalization for certain mental illnesses; and
WHEREAS, prisoners who require treatment and hospitalization for certain
mental illnesses are placed in psychiatric facilities outside of Ulster County; and
WHEREAS, Section 508 of the New York State Correction Law and 14
NYCRR 18.7 require prisoners to remain in the custody of and under sufficient guard
of the warden of the jail from which they came, unless custody is transferred to the
New York State Office of Mental Health (“NYSOMH”) pursuant to an agreement
between the warden and the Commissioner of Health; and
WHEREAS, the Ulster County Sheriff requests the Chairman of the Ulster
County Legislature and the Warden of the Ulster County Jail be authorized to
execute an agreement(s), and any amendments thereto, with the New York State
Office of Mental Health, for the transfer of the custody of prisoners to NYSOMH;
now, therefore, be it
RESOLVED, that the Chairman of the Ulster County Legislature and the
Warden of the Ulster County Jail are hereby authorized to execute an agreement(s),
and any amendments thereto, with NYSOMH for the transfer of the custody of
prisoners who require treatment and hospitalization for certain mental illnesses, in the
form as
