Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and

Deputy Chair Manna Jo Greene offer the following:

 

WHEREAS, the Ulster County Legislature approved Resolution Nos. 263 and

264 on July 15, 2014 authorizing a bond resolution and amending Capital Project 260

(the “Project”) to provide funding for construction for the Project to replace the

Bailey Bridge on Denning Road over the East Branch Neversink River; and

 WHEREAS, the project engineer had identified specific parcels of real

property over which the County needed to acquire temporary easements in order to

accomplish the Project; and

WHEREAS, upon completion of construction it was found additional

easements would be required to close out the project with New York State

Department of Transportation (NYSDOT); and

 WHEREAS, the County is negotiating with the owners of these parcels for the

acquisition of temporary easements over the parcels; and

 WHEREAS, the estimated costs for these easements should not exceed one

thousand ($1,000.00) dollars; and

 

WHEREAS, the Ulster County Legislature as lead agency under NYCRR Part

617 of the State Environmental Quality Review Act (SEQRA) has determined that

the project is an unlisted action and as lead agency has conducted a coordinated

review, and issued and adopted a negative declaration, and as such, determined that

the Project has not had a significant effect on the environment; now, therefore be it

 

 RESOLVED, the Ulster County Legislature hereby authorizes the Chairman

of the Ulster County Legislature to execute, on behalf of the County of Ulster, any

and all documents accepting the conveyance of the subject real property interest as

filed with the Clerk of the Ulster County Legislature, or as modified with the

approval of the County Attorney, 

 

and move its adoption.
