Referred to: The Legislative Programs, Education and Community Services
Committee (Chairman Donaldson and Legislators Collins, Delaune, Eckert, Haynes,
Wawro and Woltman), and The Ways and Means Committee (Chairman Gerentine
and Legislators Archer, Bartels, Lopez, James Maloney, Joseph Maloney, and Petit)
Chairman of the Legislative Programs, Education and Community Services
Committee, David B. Donaldson, and Deputy Chair Heidi Haynes, offer the
following:
WHEREAS, performing arts are an important component of our cultural
heritage, and the many performances arranged by the Ulster Performing Arts Center
(UPAC) attract Hudson Valley County residents as well as travelers to see a broad
range of entertainment for the community; and
WHEREAS, pursuant to County Law Section 224 (13), the Ulster County
Legislature appropriated to UPAC the sum of $18,750.00 in the 2018 Ulster County
Budget for the maintenance of facilities; and
WHEREAS, pursuant to County Law Section 224 (13), in order to receive
such funds, UPAC must submit to the Ulster County Legislature a verified
accounting of disbursements to be undertaken, and to the Commissioner of Finance, a
Memorandum of Receipt signed by the principal officer; and
WHEREAS, UPAC will receive payment in the amount of $18,750.00, in
accordance with the terms specified in an agreement with the County of Ulster and
UPAC and will return any unexpended funds as of December 31, 2018, along with a
certified accounting of expenditures to the Commissioner of Finance; now, therefore,
be it
RESOLVED, that the Chairman of the Ulster County Legislature is hereby
authorized to execute an agreement in the amount of $18,750.00, for the maintenance
of facilities for UPAC, in the form as filed with the Clerk of the Ulster County
Legislature or as modified with the approval of the County Attorney, Counsel to the
County Legislature, Chairman of the County Legislature, and the Chairman and
Deputy Chairman of the Legislative Programs, Education and Community Services
Committee; and, be it further
RESOLVED, that as part of the agreement, the Comptroller and/or any and all
officers of the County of Ulster, their agents and representatives, shall be allowed full
access upon reasonable notice and at reasonable times to the books, papers, records
and premises of UPAC, during the period that this resolution is in effect for the
purpose of ascertaining the manner in which the above sum of money is being used
or applied; and, be it further
RESOLVED, that the above organization agrees to comply with all applicable
Federal, State and local regulations including, in particular, any forbidding
discrimination by such organization,
and move its adoption.
