Chairman Kenneth J. Ronk, Jr. and Legislators Fabiano, Loughran, Litts, and

Maloney offer the following:

WHEREAS, the County of Ulster leases and controls certain property known

as the Ulster County Family Court Center, which is no longer sufficient for the

operations of the three Family Court Justices; and

WHEREAS, pursuant to Resolution 287, adopted on June 21, 2016, the Ulster

County Legislature selected a new site for Family Court, the Business Resource

Center (BRC) located at 1 Development Court, Town of Ulster, County of Ulster,

State of New York, and designated as SBL No.: 48.66-1-6; and

WHEREAS, the Ulster County Legislature determined that a proposition for

the approval of the removal of the Family Court, now situated in the City of

Kingston, to the BRC in Town of Ulster be put before the qualified electors of the

County at the November 8, 2016 general election; and

WHEREAS, said proposition was approved by the qualified electors of Ulster

County at the November 8, 2016 general election; and

WHEREAS, pursuant to Resolution No. 6 dated January 10, 2017, the Ulster

County Legislature established Capital Project No. 494 for the Family Court

Renovation Project at the Business Resource Center; and

WHEREAS, pursuant to Resolution No. 7 dated January 10, 2017, the Ulster

County Legislature authorized the issuance of $1,260,000.00 serial bonds for certain

design and construction management services for this renovation project; and

WHEREAS, the costs of pre-planning, planning, renovation and relocation of

the current Ulster County Family Center is expected to exceed $10,000,000.00; and

WHEREAS, the Ulster County Legislature deems this large capital project

worthy of additional oversight in order to provide reassurance to the taxpayers of

Ulster County; and 

 

 WHEREAS, pursuant to § C-11. Powers and duties of Legislature. And

Section A2-5 (11) of the Administrative Code, the Legislature is empowered “To

conduct studies and investigations in furtherance of its legislative functions and, in

connection therewith, to obtain and employ professional and technical advice,

appoint citizens' committees, commissions and boards, subpoena witnesses,

administer oaths, and require the production of books, papers and other evidence

deemed necessary or material to such studies or investigations.”; and

WHEREAS, pursuant to Section C-16 of the Ulster County Charter and

Section A2-11 of the Administrative Code: “Members of all citizens' committees,

commissions and boards appointed pursuant to § C-11K of this Charter shall serve at

the pleasure of the County Legislature. They shall serve without compensation other

than for actual and necessary expenses within appropriations made therefor, unless

otherwise provided by resolution of the County Legislature. The Chairman of the

County Legislature shall be a member ex officio of all such committees,

commissions and boards;” and

WHEREAS, pursuant to Ulster County Charter Section C-47, “The Director

of Planning and/or the County Planning Board shall perform such other and related

duties as required by the County Executive or County Legislature,” now, therefore be

it

RESOLVED, that the Special Committee to Oversee the Ulster County

Family Court Relocation is hereby created for the general oversight of Capital Project

No. 494; and, be it further

RESOLVED, that the membership of the Special Committee to Oversee the

Ulster County Family Court Relocation shall include five members of the Legislature

as follows:

• One Legislator, appointed by the Chairman of the Legislature, who shall serve

 as Chairman of the Special Committee

• The Chair of the Ulster County Legislature’s Ways and Means Committee

• One Ways and Means Committee Member appointed by the Minority Leader

• The Chair of the Ulster County Legislature’s Public Works and Capital Projects

 Committee

• One Public Works and Capital Projects Committee Member appointed by the

 Minority Leader;

and be it further 

 

RESOLVED, that the Special Committee to Oversee the Ulster County

Family Court Relocation shall first meet within thirty (30) days after all members are

appointed; and, be it further,

RESOLVED, that the Director of Planning, or designee, shall update the

Special Committee to Oversee the Ulster County Family Court Relocation at each of

its meetings as to the status of various components of the project, including but not

limited to contracts awarded pursuant to the project, timeline associated with each

component of the project and the tracking of spending on the project; and be it

further

RESOLVED, the County Executive may designate additional County staff

members to assist the Special Committee to Oversee the Ulster County Family Court

Relocation in its efforts,

and moves its adoption.
