Referred to: The Law Enforcement and Public Safety Committee (Chairman Briggs
and Legislators Fabiano, Lapp, Maio, and Rodriguez)
Legislator Ronald G. Lapp, Jr. offers the following:
WHEREAS, every day Troopers, Deputy Sheriffs, police officers, peace
officers, and first responders, including but not limited to fire personnel and EMS,
do what is necessary to serve and protect the public; and
WHEREAS, Troopers, Deputy Sheriffs, police officers, peace officers, and
first responders put their lives on the line because of the nature of their jobs; and
WHEREAS, Troopers, Deputy Sheriffs, police officers, peace officers, and
first responders must be free from all interference in the performance of their duties
and free from worry about being harmed by others to effectively perform their jobs;
and
WHEREAS, the attacks on Troopers, Deputy Sheriffs, police officers, peace
officers, and first responders have increased significantly in the last several years;
and
WHEREAS, it necessary to provide every possible protection to Troopers,
Deputy Sheriffs, police officers, peace officers, and first responders; and
WHEREAS, the Ulster County Legislature supports all Troopers, Deputy
Sheriffs, police officers, peace officers, and first responders, and is committed to
their protection; and
WHEREAS, the Ulster County Legislature finds that it is necessary to have
additional deterrents to stop the attacks on Troopers, Deputy Sheriffs, police officers,
peace officers, and first responders; and
WHEREAS, the Ulster County Legislature determines that one deterrent
would be to expand the Hate Crimes Law, New York Penal Law §485.05 to include
Troopers, Deputy Sheriffs, police officers, peace officers, and first responders,
including but not limited to fire personnel and EMS, to those victims enumerated
under the Hate Crimes Law; now it be therefore
RESOLVED, the Ulster County Legislature requests that the New York State
Legislature and the Governor enact a law to add the term “the occupation of Trooper,
Deputy Sheriff, police officer, peace officer, and first responder, including but not
limited to fire personnel and EMS” to NY Penal Law §§485.05 (1)(a) and (b) and
(2) and add “section 120.08 (assault on a Trooper, Deputy Sheriff, police officer,
peace officer, or first responder, including but not limited to fire personnel and
EMS)” and “section 120.11 (aggravated assault upon a police officer or peace
officer) to NY Penal Law §485.05 (3)”; and be it further
RESOLVED, that these intentions be transmitted to New York State Senators
George A. Amedore, John J. Bonacic, William J. Larkin, Jr. and James Seward, and
New York State Assemblymen Kevin A. Cahill, Frank K. Skartados, Brian D. Miller,
and Peter Lopez,
and move its adoption.

“including but not limited to fire personnel and EMS” in the first WHEREAS, the
last WHEREAS, and the first RESOLVED, as indicated above in bold font.
