Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and

Deputy Chairman Peter M. Loughran offer the following:

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Department of Public Works; and

WHEREAS, the Carmine Liberta Bridge (BIN # 3045230), owned by the

County, that carries New York State Route 299 over the Wallkill River in the Village

of New Paltz, and has recently been replaced; and

WHEREAS, Capital Project No. 458 was established pursuant to Resolution

478, dated December 15, 2015 for the replacement of the Carmine Liberta Bridge

(BIN #3045230); and

WHEREAS, the new Carmine Liberta Bridge (hereinafter the “Bridge”),

including the sidewalk installed on the Bridge as well as an overlook constructed

adjacent to the Bridge, will be illuminated for the safety of pedestrians, cyclists, and

those accessing the overlook; and

WHEREAS, the Village of New Paltz has agreed to assume responsibility for

general maintenance tasks and expenses associated with the lighting of the Bridge

and overlook, as well as general maintenance of the sidewalk on the bridge and the

overlook itself; and

WHEREAS, the Commissioner of the Ulster County Department of Public

Works requests that the Chairman of the Ulster County Legislature be authorized to

execute an inter-municipal agreement with the Village of New Paltz to cover said

lighting expense and provide said general maintenance; now, therefore, be it

RESOLVED, that the Chairman of the Ulster County Legislature is authorized

to execute an agreement, in the form as filed with the Clerk of the Ulster County

Legislature or as modified with the approval of the County Attorney, and any

amendments thereto, with the Village of New Paltz, for the lighting expense and the

general maintenance of the sidewalk on and overlook adjacent to the Carmine Liberta

Bridge, 

and move its adoption.
