Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and

Deputy Chairman Peter M. Loughran offer the following:

 

WHEREAS, this resolution has been submitted by the County Executive’s

Office on behalf of the Department of Public Works – Highways and Bridges; and

WHEREAS, a Project for shoulder widening and reconstruction on Route 299

(County Routes 7 & 8) from Libertyville Road to Route 44/55 in the Towns of New

Paltz and Gardiner, PIN 8051.11 (the “Project”) is eligible for funding under Title

23U. S. Code, as amended, that calls for the apportionment of the costs of such

program to be borne at the ratio of 80% Federal funds, 8% State Marchiselli funds

and 12% County funds; and

WHEREAS, the Project is listed on the Transportation Improvement Program

(TIP) under PIN 8051.11 with a date to begin the engineering design phase in 2017;

and

WHEREAS, the Federal-Aid Agreement has now been approved and requires

an approved, certified Resolution before the Agreement may be fully executed; and

WHEREAS, the Project will help improve the safety of motorists, bicyclists,

pedestrians and other users of this segment of Route 299; and

WHEREAS, Ulster County desires to advance the Project by making a

commitment of 100% of the federal and non-federal share of the costs of preliminary

engineering and right-of-way incidental work; and 

 

WHEREAS, the Commissioner of Public Works requests funds for widening

and reconstruction on Route 299 (County Routes 7 & 8) from Wallkill River on

Libertyville Road to Route 44/55 in the Towns of New Paltz and Gardiner, PIN

8051.11 (the “Project”), for the Preliminary Engineering and Right Of Way

Incidentals in the amount of $487,000.00 which is eligible for 80% Federal funds,

8% State Marchiselli funds and 12% County funds; and

WHEREAS, the project was approved by the Ulster County Transportation

Council in the 2017 – 2021 Transportation Improvement Program, now, therefore, be

it

RESOLVED, that the Ulster County Legislature hereby authorizes Ulster

County to pay in the first instance 100% of the federal and non-federal share of the

cost of preliminary engineering and right-of-way incidental work for the Project or

portions thereof, and, be it further

RESOLVED, that the sum of $487,000.00 is hereby appropriated and made

available to cover the costs of participation in the above phase of the Project, and, be

it further

RESOLVED, that the County Executive of Ulster County be and is hereby

authorized to execute all necessary Agreements, certifications or reimbursement

requests for Federal Aid and/or applicable Marchiselli Aid on behalf of Ulster

County with the New York Department of Transportation in connection with

shoulder widening and reconstruction on Route 299 (County Routes 7 & 8) from

Wallkill River on Libertyville Road to Route 44/55 in the Towns of New Paltz and

Gardiner, PIN 8051.11 (the “Project”), and the municipality’s first instance funding

of projects costs and permanent funding of the local share of federal-aid and state-aid

eligible Project costs and all Project costs within appropriations therefore that are not

so eligible, and, be it further 

 

 

RESOLVED, the 2016-2021 Ulster County Capital Fund is hereby amended

as follows:
