Chairman of the Legislative Programs, Education and Community Services
Committee, Mary Wawro, and Deputy Chairman David B. Donaldson offer the
following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Ulster County Office for the Aging; and
WHEREAS, the New York State Office for the Aging has notified Ulster
County that as a grant recipient Ulster County must enter into a Memorandum of
Agreement regarding the use of an entry of data into a statewide database or system
of records owned or maintained by the New York State Office for the Aging; and
WHEREAS, the New York State Office for the Aging has notified Ulster
County that as a grant recipient, Ulster County must enter into a Data Use
Agreement regarding the access and use by the New York State Office for the Aging
of data owned by the Ulster County Office for the Aging into the PeerPlace CloudBased Data Management System; and
WHEREAS, the New York State Office for the Aging has notified Ulster
County that as a grant recipient of the NY Connects Program and the Balancing
Incentive Program (BIP), the County must sign a new Business Associate Agreement
regarding the Agency’s responsibilities concerning the use and disclosure of
protected health information including the Health Insurance Portability and
Accountability Act; and
WHEREAS, the Director of the Office for the Aging requests the Chairman of
the Ulster County Legislature be authorized to execute the Business Associate
Agreement, the Data Use Agreement and the Memorandum of Agreement with
required assurances, and any amendments thereto; now, therefore, be it
RESOLVED, that the Chairman of the Ulster County Legislature is hereby
authorized to execute the agreement with required assurances, and any amendments
thereto, with the New York State Office for the Aging for the NY Connects and the
Balancing Incentive Program in the form as filed with the Clerk of the Ulster County
Legislature or as modified with the approval of the County Attorney; and moves its
adoption;
and moves its adoption.
