Referred to: The Laws and Rules, Governmental Services Committee (Chairman
Roberts and Legislators Belfiglio, Donaldson, R. Parete and Rodriguez), and The
Ways and Means Committee (Chairman Gerentine and Legislators Allen, Bartels,
Belfiglio, Briggs, Maio, and Maloney)
Chairman of the Legislature, Kenneth J. Ronk, offers the following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Department of Public Works; and
WHEREAS, Resolutions No. 458 approved on December 5, 2015 established
Capital Project No. 458 – Replacement of the Carmine Liberta Bridge; and
WHEREAS, the existing Carmine Liberta Bridge (hereinafter the “Bridge”)
carries a waterline that services the Village of New Paltz (hereinafter the “waterline”)
that will need to be relocated as part of the bridge replacement; and
WHEREAS, the cost associated with the waterline is solely the responsibility
of the Village of the New Paltz and
WHEREAS, the Village of New Paltz hired a consulting firm that estimated
the cost to replace the waterline at $89,500.00; and
WHEREAS, the Village of New Paltz subsequently secured funding for the
waterline replacement project from the New York Rising Program in the amount of
$89,500.00; and
WHEREAS, the funding in the amount of $89,500.00 is to be applied to
Capital Project No. 458 – Replacement of the Carmine Liberta Bridge for costs
associated with the waterline project; and
WHEREAS, pursuant to an Inter-Municipal Agreement – approved through
Resolution No. 74 of January 26, 2016 the Village of New Paltz is obligated to
reimburse the County for any and all costs associated with waterline project in excess
of the $89,500.00 already awarded; and
WHEREAS, at the request of the Village of New Paltz Department of Public
Works Supervisor, additional items were added to the original bid specs; including
but not limited to – a hydrant and valve assembly to provide fire protection for
commercial and residential properties; a new gate valve after it was discovered that
the original valves were non-functional and expanded pipeline expansion connections
totaling an additional $39,546.00; and
WHEREAS, the Village of New Paltz is solely responsible for the additional
$39,546.00 in costs associated with the waterline project component of the Carmine
Liberta Bridge Replacement Project; and
WHEREAS, due to the enhanced scope of work requested by the Village of
New Paltz, and after receipt of sealed competitive bids, the total cost of installing the
waterline is $129,046.00; and
WHEREAS, the Commissioner of Public Works hereby requests Capital
Project No. 458 be amended to reflect an increase in appropriations and revenue for
the Village of New Paltz water main installation at the Carmine Liberta Bridge in the
amount of $39,546.00, and now, therefore, be it
RESOLVED, that the 2016 Ulster County Capital Fund is hereby amended as
follows:
