Referred to: The Public Works and Capital Projects Committee (Chairman Fabiano
and Legislators Greene, Litts, Loughran, and Maloney)
Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and
Deputy Chairman Peter M. Loughran offer the following:
WHEREAS, the Ulster County Legislature approved Resolution Nos. 152, 153
and 154 on March 15, 2016, amending Capital Project No. 458 and authorizing a bond
resolution to provide funding for construction for the Project to replace the Carmine
Liberta Bridge on NYS Rt. 299 over the Wallkill River (“the Project”); and
WHEREAS, the Project engineer has identified specific parcels of real property
over which the County needs to acquire temporary easements in order to accomplish the
Project; and
WHEREAS, owners of lands associated with those easements have been
contacted, are aware of the project and amenable to a temporary easement without
compensation to allow installation of a temporary bridge and associated access road to
be removed upon completion and of the new bridge over the Wallkill; and
WHEREAS, the owners of these parcels identified below, are willing to convey
the temporary easements to the County as follows:

B) Open Space Conservancy 86.33-2-8 Temporary Easement no cost
C) Catskill Mtn. Brewing Inc. 86.33-2-7.100 Temporary Easement no cost
and;
WHEREAS, the Ulster County Legislature as lead agency under NYCRR Part
617 of the State Environmental Quality Review Act (SEQRA) has determined that the
project is a unlisted action and as lead agency has conducted a coordinated review, and
issued and adopted a negative declaration, and as such, determined that the Project will
not have a significant effect on the environment; now, therefore, be it
RESOLVED, the Ulster County Legislature hereby authorizes the Chairman of
the Ulster County Legislature to execute, on behalf of the County of Ulster, any and all
documents accepting the conveyance of the subject real property interest as filed with
the Clerk of the Ulster County Legislature, or as modified with the approval of the
County Attorney,
and move its adoption.
