Amending The 2016 Ulster County Budget To Reimburse Indicated Ulster County Towns For Flood Mitigation Work In The Wake Of Hurricane Irene

Briggs, Maio, and Maloney)

Legislators James F. Maloney and John R. Parete offer the following:

WHEREAS, Hurricane Irene devastated Ulster County leaving in its wake

considerable property damage; and

WHEREAS, local towns quickly responded and repaired impacted roads

thereby returning the quality of life and access to remote areas for residents and

emergency vehicles; and

WHEREAS, Empire State Development of New York State approved

reimbursement funding for work performed pending the verification of procurement

procedures; and

WHEREAS, as part of the New York State grant process, the County of Ulster

is required to undertake efforts to facilitate the release of grant funding approved

through the New York Works Program; and

WHEREAS, the Towns of Hardenburgh, Lloyd, Saugerties, Shandaken, and

Ulster, in reliance upon its approval for a grant through the New York Works

Program, completed necessary steps to contract with approved vendors and/or

completed the work in house to remediate flood damage and help mitigate future

flooding on impacted roads; and

WHEREAS, the County of Ulster has yet to file the required paperwork to

proceed with the grant process and, as a result, the sum of $126,838.56 has not been

released to the impacted Towns to cover their flood remediation and mitigation costs;

and

WHEREAS, as stated in a December 9, 2015 Memorandum issued by the

Office of the County Executive, the Towns have paid in full the reimbursable

amounts as follows:

; and

WHEREAS, the Towns continue to suffer financial hardship as a result of the

flood remediation and mitigation costs; now, therefore, be it

RESOLVED, that the 2016 Ulster County Budget is hereby amended as

follows:

and be it further, 

 

RESOLVED, that no County money shall be paid to the indicated Towns until

a Memorandum of Receipt signed by the Supervisor of each of the indicated Towns,

providing for the County of Ulster’s full reimbursement in the event the indicated

Town receives flood remediation monies from the State of New York and/or the New

York Works Program, is delivered to the Commissioner of Finance; and, be it further

RESOLVED, after delivery of the Memorandum of Receipt, but no later than

June 1, 2016, the Commissioner of Finance is authorized and directed to issue

payment in the amount of $25,300.88 to the Town of Denning, $15,074 to the Town

of Hardenburgh, $26,240 to the Town of Lloyd, $22,138 to the Town of Saugerties,

$28,400.39 to the Town of Shandaken, and $9,385.29 to the Town of Ulster for flood

remediation and mitigation costs stemming from Hurricane Irene, and be it further

RESOLVED, that the Commissioner of Finance is hereby authorized to

make any and all budget modifications, transfers and entries necessary to

effectuate the disbursement of funds to the various eligible towns,

and move its adoption.

line from which the funds will be transferred from, and to add an additional
