Authorizing The Chairman Of The Ulster County Legislature To Execute An Amendment To The Service Agreement With The Ulster County Resource Recovery Agency

Maio, Maloney, and Richard Parete)

Legislators Richard A. Gerentine and John Parete offer the following:

WHEREAS, the County of Ulster and the Ulster County Resource Recovery

Agency (RRA) have entered into and have previously amended the Service

Agreement; and

WHEREAS, the Service Agreement expires on March 31, 2025; and

WHEREAS, the RRA has the ability to bond up to $40 million dollars without

County approval; and

WHEREAS, the RRA has issued bonds that currently amount to

approximately $12.1 million; and

WHEREAS, the County has a financial obligation to the RRA for any bonds it

issues in the form of a net service fee; and

WHEREAS, the County, through its Legislature, has determined that, in the

interest of protecting the health, safety, and welfare of Ulster County residents, the

County should have greater involvement with the long-term debt incurred by the

RRA due to the net-service fees; and

WHEREAS, the RRA has previously agreed to the County having oversight

over the Agency’s bonding authority; and

WHEREAS, the County and the RRA desire to amend the Service Agreement

to achieve the purpose described above; now, therefore, be it

RESOLVED, that the Chairman of the Legislature is authorized to sign an

amendment to the Service Agreement with the RRA that requires the RRA to obtain

the Legislature's approval prior to issuing bonds in the amount of $500,000 or more,

in the form as filed with the Clerk of the Ulster County Legislature,

and move its adoption.
