Referred to: The Economic Development, Tourism, Housing, Planning and Transit
Committee (Chairman Briggs and Legislators Allen, Archer, Bartels, Litts, Maio and
Maloney)
Chairman of the Economic Development, Tourism, Housing, Planning, and Transit
Committee, Thomas J. Briggs, and Deputy Chairman James F. Maloney offer the
following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Department of Transportation (Ulster County Area Transit); and
WHEREAS, the County presently operates a public transit system throughout
Ulster County, including ingress and egress to various municipalities; and
WHEREAS, the County and various municipalities desire to enhance the
public transportation service and improve passenger safety and convenience through
the installation of bus shelters within the various municipalities; and
WHEREAS, New York State’s General Municipal Law Article 5-G and
Section A3-4 (Y) of the Ulster County Administrative Code provide that the
Chairman of the Ulster County Legislature can enter into an inter-municipal
agreement on behalf of the County of Ulster; and
WHEREAS, the Director of Public Transportation is requesting that the
Chairman of the Ulster County Legislature be authorized to execute an intermunicipal agreement with the Village of Ellenville, as well as additional intermunicipal agreements with various local municipalities for the distribution to the
municipalities of bus shelters currently in the County’s inventory; and
WHEREAS, the municipalities receiving bus shelters will be responsible for
their installation and upkeep as well as for maintenance of adequate insurance
coverage; now, therefore, be it,
RESOLVED, that the Chairman of the Ulster County Legislature is authorized
to execute a bus shelter agreement with the Village of Ellenville, in the form as filed
with the Clerk of the Ulster County Legislature or as modified with the approval of
the County Attorney, as well as additional bus shelter agreements with various local
municipalities as may be submitted to the Chairman in the future,
and move its adoption.
