Chairwoman of the Economic Development, Planning, Education, Employment, Arts and Agriculture Committee, Megan Sperry, and Deputy Chair Herbert Litts, III offer the following:
WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Department of Planning; and
WHEREAS, Verizon New York, Inc. (Verizon). currently holds and easement cross lands owned by Ulster County located on Golden Hill to construct, reconstruct, relocate, replace, operate, repair, maintain and remove wire, equipment, conduit ,cable, cable cabinets and fixtures; and
WHEREAS, the easement encroaches on lands associated with the Golden Hill Housing Development Project, and is no longer needed by Verizon; and
WHEREAS, Verizon has indicated that it wishes to extinguish this easement, via the execution of a quite claim deed; now, therefore be it
RESOLVED, that the Ulster County Legislature, hereby determines that the extinguishing of this easement constitutes a Type II action as defined under Sections 2.11 of the County of Ulster’s State Environmental Quality Review Act (SEQRA) Type II List, which was adopted pursuant to Resolution No. 118 dated April 20, 2010; and, be if further
RESOLVED, the Ulster County Legislature hereby authorizes the Chair of the Ulster County Legislature to execute, on behalf of the County of Ulster, all agreements and documents related to extinguishing said easement with Verizon as approved by the County Attorney,
and moves its adoption.
