Referred to: The Ways and Means Committee (Chairman Gerentine and Legislators
Bartels, Belfiglio, Briggs, Maio, Maloney, Richard Parete, and Rodriguez)
Chairman of the Ways and Means Committee, Richard A. Gerentine, offers the
following:
WHEREAS, the County Executive developed the 2014 Ulster County Budget
under unprecedented fiscal challenges caused by the New York State Assembly’s
failure to extend the County’s authority to impose an additional 1% sales tax that has
been in place for over 20 years; and
WHEREAS, the collection of sales tax is spread across all consumers, not
only those that live in Ulster County, and is a way to offset the burden of property tax
payers; and
WHEREAS, the 2014 Budget was developed utilizing projections relevant to
two different scenarios: Ulster County being granted authority to continue the
additional 1% sales tax levy on February 1, 2014, or March 1, 2014; and
WHEREAS, the County’s authority to collect the additional 1% sales tax
expired on December 1, 2013; and
WHEREAS, in order to continue to provide seamless services to residents, the
County Executive developed sequestration, a unique budgetary tool which provides
for a progression of spending cuts should Ulster County’s 1% sales tax not be
extended; and
WHEREAS, the loss of the 1% additional sales tax equals a loss of revenue to
Ulster County of over $22 million for fiscal year 2014; and
WHEREAS, to partially address the potential massive loss of revenue, the
adopted 2014 Ulster County Budget sequestered $1,164,706.00, the funding
necessary for various County departments to continue to provide services at their
current levels, as well as management salary adjustments, and placed the funds in
Contingency; and
WHEREAS, the salaries of Ulster County managers who are not represented
by a collective bargaining unit have remained unchanged since 2009 and it is
appropriate to increase salaries by 2% effective and retroactive to January 1, 2014;
and

WHEREAS, the County has now been granted the authority by the New York
State Legislature to continue the 1% additional sales tax rate, effective February 1,
2014; and
WHEREAS, by Resolution No. 392 dated December 17, 2013, the Ulster
County Legislature authorized the transfer of sequestered funds from contingency to
cover the costs of services performed by contract agencies; and
WHEREAS, it is now necessary to transfer the balance of the sequestered
funds from the Contingency account and appropriate the funds to the appropriate
budget lines of the various County department; now, therefore, be it
RESOLVED, that the 2014 Ulster County Budget is hereby amended as
follows:

RESOLVED, the Commissioner of Finance is hereby authorized to make any
and all budget adjustments necessary to transfer and appropriate the sequestered
funds from contingency into the appropriate budget lines of the various County
departments; and, be it further

RESOLVED, that a 2% salary adjustment for managers not represented by a
collective bargaining unit effective and retroactive to January 1, 2014 is hereby
approved,
and moves its adoption.
