Referred to: Law Enforcement and Public Safety Committee (Chairman Briggs and
Legislators Gregorius, Loughran, Maio and Ronk), The Public Works and Capital
Projects Committee (Chairman Fabiano and Legislators Allen, Greene, Loughran,
and Roberts), and The Ways and Means Committee (Chairman Gerentine and
Legislators Bartels, Belfiglio, Briggs, Maio, Maloney, Provenzano, and Rodriguez)
Chairman of the Law Enforcement and Public Safety Committee, Thomas J. Briggs,
and Deputy Chairman Kenneth J. Ronk offer the following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Department of Emergency Communications/Emergency Management;
and
WHEREAS, pursuant to Resolution No. 98, dated March 18, 2014, the Ulster
County Legislature authorized the Chairman to execute an agreement with the New
York State Division of Homeland Security and Emergency Services (DHSES),
wherein DHSES, as authorized and funded by the Federal Emergency Management
Agency (FEMA) agreed to pass FEMA funding to the County, and the County agreed
to administer a program (the “Program”) designed to purchase and demolish homes
damaged during Hurricane Irene and Tropical Storm Lee; and
WHEREAS, said Resolution No. 98 further established Ulster County Capital
Project No. 406 to fund the Program; and
WHEREAS, the Program will provide reimbursement funding for thirty-four
homes in the Towns of Kingston, Olive, Shandaken, Ulster, Wawarsing, and
Shawangunk; and
WHEREAS, the FEMA Program, through the NYS DHSES, would provide
75% of the cost of each property purchase, and the State of New York has agreed to
fund the remaining 2

Authorizing The Chairman Of The Ulster County Legislature To
Execute Agreements With The City Of New York And Various
Towns For The Purchase And Demolition Of Homes Damaged
During Hurricane Irene And Tropical Storm Lee – Department of
Emergency Communications / Emergency Management
WHEREAS, the City of New York or one of the Towns will take title to the
properties of those who are able to successfully fulfill the requirements of the
Program; the County will not take title to any of the properties participating in this
Program; and
WHEREAS, the Director of Emergency Communications/Emergency
Management is requesting that the Chairman of the Ulster County Legislature be
authorized to execute those agreements, and any amendments thereto, with the City
of New York and with those towns choosing to take title to the property purchased
under the terms of the Program; and
WHEREAS, the requested authorization constitutes a Type II action under
sections 4.2.1 and 4.2.4 of the County of Ulster’s State Environmental Quality
Review Act (SEQRA) Type II List that was adopted in Resolution No. 118 on April
20, 2010; and
WHEREAS, Ulster County determines that this action does not pose a
significant potential environmental impact and may be progressed as a Type II action
in accordance with 6 NYCRR Part 617 of SEQRA; now, therefore, be it
RESOLVED, that the Chairman of the Ulster County Legislature is hereby
authorized to execute an agreement, any amendments thereto, and such other
documents as may be necessary, with the City of New York, by and through its
Department of Environmental Protection, to establish the terms and conditions
pursuant to which the City of New York will participate in the FEMA Hazard
Mitigation Grant Program and take title to certain properties, in the form as filed with
the Clerk of the Ulster County Legislature, or as modified with the approval of the
County Attorney; and, be it further
RESOLVED, that the Chairman of the Ulster County Legislature is hereby
authorized to execute agreements, any amendments thereto, and such other
documents as may be necessary, with certain towns in the County of Ulster, to
establish the terms and conditions pursuant to which said towns will participate in the
FEMA Hazard Mitigation Grant Program and take title to certain properties, in the
form as filed with the Clerk of the Ulster County Legislature, or as modified with the
approval of the County Attorney and Chairman of the Ulster County Legislature,
