Referred to: The Ways and Means Committee (Chairman Gerentine and Legislators
Bartels, Belfiglio, Briggs, Maio, Maloney, Provenzano, and Rodriguez)
Chairman of the Ways and Means Committee, Richard A. Gerentine, and Deputy
Chairman Tracey A. Bartels offer the following:
WHEREAS, this resolution has been submitted by the County Executive on
behalf of the Department of Purchasing; and
WHEREAS, Resolution No. 66 of March 12, 1992, adopted the Policies and
Procedures for the Ulster County Purchasing Department in accordance with Sections
103 and 104-b of New York’s General Municipal Law; and
WHEREAS, the Policies and Procedures were revised pursuant to Resolution
No. 93 of March 9, 2000; and
WHEREAS, the Policies and Procedures were further revised and adopted
pursuant to Resolution No. 365 of December 16, 2009; and
WHEREAS, it remains Ulster County’s objective to obtain materials, supplies,
equipment, technology, and services that are of suitable quality, in the accurate
quantity, from the right source, at the most competitive price, in compliance with all
applicable legal requirements ensuring that taxpayer dollars are expended in the most
efficient manner and in accordance with the County’s Policies and Procedures; and
WHEREAS, the New York State Legislature has updated Sections 103 and
104-b of New York’s General Municipal Law to allow municipalities to award bids
on the basis of “Best Value”, accept electronic bidding, and purchase goods through
national and regional cooperative purchasing contracts; and
WHEREAS, the Ulster County Department of Purchasing, in conjunction with
the Ulster County Attorney’s Office, has revised its Policies and Procedures to
provide County Officials and employees along with the County’s business partners, a
more comprehensive and user-friendly Procurement Manual; now, therefore, be it
RESOLVED, that the Ulster County Legislature hereby adopts the updated
Policies and Procedures of the Ulster County Department of Purchasing as set forth
in the Procurement Manual,
and move its adoption.
