Legislator Lynn Archer and Legislators Gregorius, Provenzano, and Wishnick offer

the following:

 WHEREAS, Senate Bill 06417 and Assembly Bill 8740 have been introduced

in the 2013-2014 Legislative Session which reimburses counties and the City of New

York the costs associated with administering a second primary elections as a result of

not combining State and Federal primaries; and

 WHEREAS, the Federal Overseas Voter Empowerment (MOVE) Act required

primary elections dates that allow military and overseas citizens to register and vote

with sufficient time for their ballots to be sent, delivered, cast, returned and counted;

and

 WHEREAS, U.S. District Court Judge Gary Sharpe (N.D.N.Y.) has ordered

that this year’s primary for federal offices are to be conducted on June 24, 2014; and

WHEREAS, because New York State has again not changed the date of the

State and local primaries to match the Federal primary date, the result will again be

two complete election cycles, including petitioning, machine set up and

programming, election day voting procedures and canvas and re-canvas processes;

and

 WHEREAS, in 2012, Ulster County’s cost for the two separate primaries was

$72,609.66 for the Federal primary and $62,432.69 for the State and local primary;

and

 WHEREAS, this legislation will not only reimburse the estimated expenses

for a second primary, it will address an unfunded and unnecessary mandate; now,

therefore be it

 RESOLVED, that the Ulster County Legislature urges the New York State

Governor and Legislature to ensure the passage of Senate Bill 6417 and Assembly

Bill 8740 within this legislative session; and, be it further

RESOLVED, the Clerk of the Ulster County Legislature shall forward copies

of this resolution to Governor Andrew Cuomo, New York State Senate Majority CoLeader Dean Skelos, Majority Co-Leader Jeff Klein, Senate Minority Leader Andrea

Stewart-Cousins, Senate Election Committee Chair Thomas O’Mara, and Senators

William Larkin, Jr., John Bonacic, Cecelia Tkaczyk and James Seward, New York

State Assembly Speaker Sheldon Silver, Assembly Majority Leader Joseph Morelle,

Assembly Minority Leader Brian Kolb, Assembly Election Law Committee Chair

Michael Cusick and Assemblymen Claudia Tenney, Peter Lopez, Kevin Cahill and

Frank Skartados,

and move its adoption.
