Chair of the Legislature, Peter J. Criswell, offers the following:
WHEREAS, the County of Ulster and the Ulster County Resource Recovery Agency (UCRRA) have entered into and have previously amended the Service Agreement; and
WHEREAS, discussions regarding a new solid waste service agreement between Ulster County and UCRRA are ongoing; and
WHEREAS, Ulster County and UCRRA have previously agreed to extend the existing agreement by sixty-days to allow for additional time for negotiations; and
WHEREAS, pursuant to Amendment No. 5 to the Service Agreement, dated as of September 23, 2015, the Agency shall not issue bonds in the amount of $500,000 or more without obtaining prior approval from the County, acting through its Legislature; and
WHEREAS, in order to purchase the Real Property and related expenditures, the Agency wishes to have its ability to issue bonds in an amount above the amount as set forth in Amendment No. 5 to the Service Agreement, and the County has agreed to increase the amount by which the Agency can bond for the sole purpose of purchasing the Real Property as set forth herein; now, therefore be it
RESOLVED, the Ulster County Legislature hereby authorizes the Chair of the Ulster County Legislature to sign an amendment to the Service Agreement with the UCRRA that sets a maximum bond amount of $10 million dollars for the sole purpose of purchasing Real Property as forth in the agreement, in the form as filed with the Clerk of the Ulster County Legislature,
and move its adoption.
