Chairwoman of the Law Enforcement and Public Safety Committee, Gina Hansut, and Deputy Chair Chris Hewitt offer the following:

 

WHEREAS, this resolution has been submitted at the request of the Ulster County District Attorney; and

 

WHEREAS, Governor Kathy Hochul secured an additional $40 million in the State Fiscal Year (SFY) 2023-2024 Budget and $47 million in the SFY 2024-2025 Budget to assist in county prosecution efforts across the 62 Counties of New York State; and

 

WHEREAS,theUlsterCountyDistrictAttorney (UCDA)wasawarded $569,197.00 in Aid to Prosecution (ATP) funding pursuant to letter dated August 24, 2023 issued by the New York State Division of Criminal Justice Services (DCJS), which was disbursed to the County in one payment; and

 

WHEREAS, pursuant to Resolution 117 ofMarch 19, 2024, the 2024 Operating Budget was amended to allocate said funds to the UCDA; and

 

WHEREAS, there is a remainder of $79,622.00 from the SFY 2023-2024 ATP fund which is currently earmarked pursuant to the enabling Legislation for use only by the Ulster County District Attorney for recruitment, retention, and other prosecutorial services and not for any other purpose; and

 

WHEREAS, there exists a 2024 Aid to Prosecution (ATP) budget balance of $79,622.00 to be rolled over into the 2024 Budget; and

 

WHEREAS, it is necessary to adjust the Budget to reflect the net difference of the rollover balance and State allotment in funding; and

 

WHEREAS, the District Attorney requests the 2024 Aid to Prosecution appropriations and revenues be increased by $79,622.00 rollover; and


 

 

WHEREAS, the Governor’s Office and DCJS have made it clear that the grant funding is intended to be used for pay raises, stipends, community programming, and support for expenses to aid District Attorney’s Offices in ongoing efforts to recruit and retain personnel and efficiently comply with the increased workloads resulting from the 2020 discovery requirements and other changes to our criminal laws and prosecutions for the purpose and furtherance of public safety and the remaining outstanding budget balances reflect these requirements; now, therefore, be it
