WHEREAS, the wages of all persons performing duties for Ulster County are of concern to the Ulster County Legislature; and

 

WHEREAS, a significant proportion of duties executed on behalf of Ulster County are performed by outside vendors; and

 

WHEREAS, the wages of those performing duties on behalf of Ulster County have the capacity to impact the work being performed and the ability of the broader County workforce to retain its many talented and caring professionals performing work on behalf of the County; and

 

WHEREAS, the residents of Ulster County rely on myriad services, including but not limited to services provided directly to residents by caring and talented individuals who may be employees of Ulster County or may be employees of contracted vendors; and

 

WHEREAS, pursuant to Section C-11 of the Ulster County Charter and Section A2-5(A) of the Ulster County Administrative Code, the Ulster County Legislature is “the legislative, appropriating and policy determining body of the County and, as such, shall have and exercise all powers and duties now or hereinafter conferred upon it by applicable law and any powers necessarily implied or incidental thereto”; and

 

WHEREAS, pursuant to Section C-11(h) of the Ulster County Charter and Section A2-5(A)(8) of the Ulster County Administrative Code, the Ulster County Legislature is empowered to fix the compensation of all officers and employees paid from County funds, or, for employees not covered by a collective bargaining agreement, to establish salary ranges within which the appointing authority shall have discretion to set the actual salary within a range”; and

 

WHEREAS, Ulster County and the Ulster County Legislature require timely and accurate information on the wages and salaries paid to the people working for its contractors and subcontractors; and

 

WHEREAS, the County Legislature wishes to require any contractor or subcontractor providing goods or services to the County to submit a certified payroll, including all of its employees that provide, or assist in providing, such goods and services to the County; and

 

WHEREAS, the County Legislature intends such requirement to be included in the contracts that the County enters into with its contractors and subcontractors; and

 

WHEREAS, the County Legislature wishes to evaluate the information submitted by the contractors and subcontractors selected to provide goods or services to the County in order to properly fulfill its fiduciary responsibly to the Ulster County taxpayers; and

 

WHEREAS, County Legislature wishes the County’s Procurement Manual to be updated by adding a new paragraph II. A. 9 in section II (“General Purchasing Procedures”); now, therefore, be it

 

RESOLVED, that the Ulster County Legislature hereby adopts the updated Policies and Procedures as set forth in the Procurement Manual, attached hereto as Exhibit A,

 

and move its adoption.
