Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and Deputy Chair Manna Jo Greene offer the following:

 

            WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Public Works; and

 

WHEREAS, COVID-19 is an infection associated with fever and signs and symptoms of pneumonia or other respiratory illness, and appears to be transmitted from person to person predominately through droplet transmission, and if spread in the population could have serious public health consequences; and

 

WHEREAS, on March 7, 2020, Governor Cuomo issued Executive Order 202, declaring a State disaster emergency for the entire State of New York in response to cases of COVID-19 documented within New York State, with the expectation that the number of cases was expected to rise; and

 

WHEREAS, on March 20, 2020, the Federal Emergency Management Agency (“FEMA”) issued a Major Disaster Declaration for New York State, dating back to January 20, 2020, relating to the exigent and emergency circumstances created by the COVID-19 pandemic; and

 

WHEREAS, in response to the COVID-19 pandemic, consistent with guidance from public health officials, the County established a COVID-19 testing site located within the boundaries of the Town; and

 

WHEREAS, the Town’s Police Department has provided necessary security and supplies in support of the County’s COVID-19 testing site (the “Security Services”) in the amount of $17,665.76, which were not otherwise available to the County; and

 

WHEREAS, FEMA’s Public Assistance Program provides grants to reimburse contracts entered under exigent or emergency circumstances that are compliant with its procurement standards; and

 

 

 

WHEREAS, through this Agreement, the Parties desire to memorialize the County’s agreement to pay the Town for its provision of Security Services, and to ensure compliance with guidelines issued by FEMA’s Public Assistance Program; and, be it further

           

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to enter into an agreement, and any amendments thereto, with the Town of Ulster for Security Services, for the period February 27, 2020 through May 16, 2020, in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney,

 

and move its adoption.
