Referred to: The Economic Development, Tourism, Housing, Planning and Transit Committee (Chairman Woltman and Legislators Archer, Delaune, Litts, Maio, Joseph Maloney, and Rodriguez)
Legislators Hector Rodriguez and Kenneth Ronk, Jr. offer the following:
WHEREAS, Resolution 140 of 1996 adopted and confirmed the policies and procedures of Ulster County's Section 108 Guaranteed Loan Program; and
WHEREAS, Resolution 216 of 1996 authorized the County to apply for Section 108 loan funds; and,
WHEREAS, pursuant to Resolution No. 402, dated December 29, 1998, the membership of the Ulster County Development Corporation Loan Committee, later renamed the Ulster County Revolving Loan Fund Committee (UCRLF), was created; and
WHEREAS, the Ulster County Legislature has previously engaged the services of the former Ulster County Development Corporation until its disillusion in 2014; and
WHEREAS, Resolution 317 of 2017, Amending the Membership of the Ulster County Revolving Loan Fund Committee, reorganized and reestablished the current authority of the legislature with the UCRLF; and
WHEREAS, the Ulster County Legislature engaged the services of the Ulster County Economic Development Agency (EDA) for administration of the UCRLF until December 31, 2018; and
WHEREAS, in an email to the UCRLF members, EDA staff unilaterally cancelled all future meetings of the UCRLF; and
WHEREAS, the Ulster County Legislature now desires to administer those funds itself; now, therefore be it
RESOLVED, the Ulster County Legislature hereby assigns the care and custody of all Ulster County Revolving Loan Funds, including but not limited to former CDBG funds and HUD Section 108 funds, to the Office of the Clerk of the Ulster County Legislature; and, be it further
RESOLVED, the Ulster County Legislature herby assigns all administrative duties for the UCRLF to the Office of the Clerk of the Ulster County Legislature; and, be it further
RESOLVED, the 2020 Ulster County Budget for the Office of the Clerk of the Legislature shall include an amount equal to the administrative fees paid to the EDA to fulfill those duties; and, be it further
RESOLVED, the Ulster County Legislature, hereby serves notice to the UCEDA that its services relating to the UCRLF are hereby terminated; and, be it further
RESOLVED, the Ulster County Legislature re-asserts all management and control of/over the UCRLF and its funds,
and move its adoption.
