Legislator Joe Maloney offers the following:

WHEREAS, Resolution No. 321, adopted July 20, 2021, approved the Memorandum Of Agreement between the County of Ulster and The Ulster County Civil Service Employee Association; and

WHEREAS, the agreement is for the period January 1, 2020 through December 31, 2024; and

WHEREAS, the contract resulted in a $5.70 across the board increase to the DPW salary schedule beginning December 31, 2020; and

WHEREAS, upon ratification of the agreement, the Legislature, as well as members of the DPW workforce, understood the agreement fairly applied to all titles within the department stating wages were “increased by $5.70 across the board”; and

WHEREAS, the Legislature has been notified that the increase to DPW has only been applied to a limited number of positions within the department; and

WHEREAS, it remains the Legislature’s intent and understanding that the contractual increase of $5.70 across the board applies to all Civil Service Employee Association positions within the Department of Public Works; and

WHEREAS, it has become necessary to retroactively apply the contracted increase to the employees who have not yet received it to comply with the terms and intent of the bargaining agreement; now, therefore, be it

RESOLVED, that the Ulster County Budget is hereby amended pursuant to the schedule on file with the Clerk of the Legislature which includes all positions within the Department of Public Works within the DPW Salary Schedule; and, be it further

RESOLVED, the Commissioner of Finance is hereby authorized and directed to make any and all budget amendments required to transfer and appropriate the necessary funds into the appropriate budget lines to pay the employees affected by this Resolution and the corresponding collective bargaining agreement,

and move its adoption.
